Hotels that had an agreement with Booking.com between 2004 and 2024 can now file a compensation claim to recover part of the overpaid commission. The collective claim is supported by KHN, HOTREC (the European hospitality industry umbrella organisation) and 25 other industry associations in Europe.
Booking.com used so-called parity clauses for years. As a result, hotels were not allowed to offer lower prices or better conditions through other booking sites or their own website. These clauses restricted competition between platforms as well as the ability of hotels to sell directly to guests.
In September 2024, the European Court of Justice ruled that this practice violated European competition law. This laid the legal basis for a damages claim. The damage is huge: preliminary calculations by competition lawyers and economists point to at least 30% of the commission paid over the past 20 years, plus interest.
Together with HOTREC and other European industry associations, we support the collective claim for damages against Booking.com. The negotiations and any proceedings will be conducted by the independent Hotel Claims Alliance Foundation. Participation in the action is completely free of charge and without legal risk.
All hotels in the Netherlands (and the rest of Europe) that had an agreement with Booking.com between 2004 and 2024 can participate, so even if you are not a member of KHN or another industry organisation.
